These Terms and Conditions (“Terms”) govern your use of the LUXIO Lab™ platform, which is owned and operated by The Scaling Firm™ in partnership with Ryan Lee, founder of Landscape Lighting Secrets™. By accessing or using LUXIO Lab™, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the platform.

User Eligibility:

LUXIO Lab™ is intended for use by professional landscape lighting contractors and business owners who are at least 18 years old. By registering for and using the platform, you confirm that you meet this eligibility requirement and agree to provide accurate and complete information during the registration process.

Account Responsibilities:

As a user of LUXIO Lab™, you are responsible for maintaining the confidentiality of your account login credentials. You agree not to share your account information with unauthorized individuals and to notify us immediately if you believe your account has been compromised. You are also responsible for ensuring that all activity under your account complies with these Terms.

If you permit others to use your account, you are responsible for their actions. Any violations of these Terms by users under your account may result in the suspension or termination of your access to LUXIO Lab™.

Billing and Subscription:

LUXIO Lab™ operates on a subscription model. By subscribing, you agree to pay the fees associated with your plan, which will be billed either monthly or annually. Payments are processed via Stripe, and your subscription will automatically renew unless canceled. You can cancel your subscription through your account settings at any time, but you will remain responsible for payment until the end of your current billing cycle.

Refunds are generally not provided unless required by law or in exceptional cases. To avoid automatic renewal, you must cancel your subscription at least three days before your next billing date.

Prohibited Use:

You agree not to misuse or abuse the platform. This includes, but is not limited to, the following activities:

Reselling or distributing access to LUXIO Lab™

Using the platform for illegal or unethical purposes

Attempting to reverse-engineer, tamper with, or otherwise interfere with the platform’s functionality

Posting or uploading content that violates the rights of others

Violation of these terms may result in immediate suspension or termination of your account, without refund.

Intellectual Property:

LUXIO Lab™ is the proprietary property of The Scaling Firm™ and Ryan Lee, including all software, content, designs, and materials. As a subscriber, you are granted a limited, non-transferable license to use the platform for your business operations. You may not copy, reproduce, or redistribute any of the intellectual property contained within the platform without express permission.

Cancellation and Termination:

You may cancel your subscription at any time, but you will continue to have access to LUXIO Lab™ until the end of the billing cycle. We reserve the right to suspend or terminate your account at our discretion, particularly if we suspect fraudulent activity or violation of these Terms. If your account is terminated, we may retain certain data for legal or regulatory purposes but will delete your account upon request after 30 days.

Limitation of Liability:

LUXIO Lab™ is provided on an “as is” basis. While we strive to provide the best possible service, we cannot guarantee that the platform will meet all your expectations or that it will always function without interruption. We are not responsible for any loss of data, business, or revenue that occurs as a result of using the platform.

Our liability, to the extent permitted by law, is limited to the amount you have paid for the service in the last 30 days. We are not liable for any indirect, incidental, or consequential damages.

Dispute Resolution:

Any disputes related to these Terms will be resolved through binding arbitration, in accordance with the laws of the state of [Insert State]. By using LUXIO Lab™, you agree to resolve disputes through arbitration rather than through the courts.
